"We have a validated method developed specifically for testing “water soluble” hemp extracts. However, in the production of soda and other aqueous (water-based) products the “water soluble” hemp extracts have already been solubilized or dissolved by water as the majority of the soda is carbonated water. Thus, the analytical recovery of cannabinoids, if present, is then a relatively simple process. Again, as we discussed, Ryan, as these samples were subsampled it is possible that the cannabinoids could have “fallen out” of the solution and were not homogenously distributed at the time when the subsample was taken and submitted to Botanacor for analysis."

Q: So, who won the case?
No one.
Q: Why did you file for a trademark?
The parties had an Operating Agreement as "Dram Drinks, LLC” with a 51/49% split. The trademarks are to protect all the beverages produced for the members of the company, of which the majority (51%) is owned by the Dram parties.
Q: You had an operation agreement?
Yes, one signed by all parties in 2016.
Q: Did you pressure DRAM into an agreement?
It was mutually agreed on by all parties to create an operating agreement that was signed by all parties under no duress.
Q: Why did the courts not side with you on this?
The courts sided with no one.
Q: Why were no damages awarded?

Dram seemed to use that as a linchpin to somehow justify their actions. Water soluble hemp extracts are difficult to test accurately due to a variety of factors. The lab that did the test for the segment admitted as much:

Q: Are you just another set of predatory males out there to hurt women?
For DRAM to use this very inflammatory and very personal accusation without any merit whatsoever is offensive and wrong. We are, as people, very empathetic to anyone that deals with the reality of predators in their lives. There is nothing predatory and “Male oriented” about anything we do in our business. We make soda pop to be enjoyed by everybody and run a company with a family and friendly ideology at the forefront of our philosophy. We know unequivocally this is unfounded.
Q: Why did things blow up after so many years in business?
Dram was actively pursuing funding and got approached from a venture capital firm from California. They then wanted out of their existing agreement. As evidenced from the timeline this is problematic.
Q: COLORADO’S BEST DRINKS...CBD, we are confused?
CBD is initialism for the brand name Colorado's Best Drinks. There is also CBD (cannabidiol) among the cannabinoids found in the water soluble hemp extract used in Colorado's Best Drinks' beverages.
